The Guardianship Process

In the state of Wisconsin, you can work with the Register in Probate Office in your county. There are forms to fill out. (link to forms in “Useful Website” tab)  We had an attorney fill them out, however you do not have to have an attorney. Once the forms are all filled out, a Guardian Ad Litem will be appointed on behalf of the child. A court date is also scheduled.

We had a home visit from the Guardian Ad Litem, where she made an evaluation based upon questions and observations.

Once that process was complete, our court date was upon us. We appeared in court where the Guardian Ad Litem presented the facts, the judge asked a few questions. Then guardianship was granted. The entire process took about 5 weeks, depends on how busy the court docket is.

We have full legal permanent guardianship, which qualifies our grandchild to obtain insurance through my husband. We have also applied for The Kinship Program. Which forms need to be filled out and if approved, a monthly check is sent out to help with the costs for the child. The is a state program. Once this is obtained, you can also apply for other programs, such as WIC and Medicaid. In a lot of cases, but not all, the income guidelines are different for grandparents who have guardianship.
